1. Who You Are Contracting With
These Terms of Service ("Terms") are a legal agreement between you and Townrents LLC, a limited liability company organized in the United States, doing business as "MudHub" ("MudHub," "we," "us," or "our"). These Terms govern your access to and use of the MudHub website, mobile applications, calculators, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility and Authority
You must be at least 18 years old to use the Service. If you use the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.
3. Informational Use Only — No Professional Services
MudHub provides informational tools for concrete contractors, including calculators, estimating aids, joint layout suggestions, supplier directories, project management features, and related planning content. The Service is intended solely as a productivity and record-keeping aid.
- MudHub does not provide engineering services.
- MudHub does not provide architectural services.
- MudHub does not provide professional design services.
- MudHub does not replace project plans, structural engineering, applicable building codes, manufacturer recommendations, geotechnical reports, soil analysis, jurisdictional inspection, or the professional judgment of a licensed contractor.
Any output produced by the Service — including concrete volumes, bag counts, joint layouts, cost estimates, supplier suggestions, and mix guidance — is informational only.
4. User Responsibility
You are solely responsible for:
- Verifying all dimensions, measurements, and inputs.
- Verifying all calculations, quantities, and layouts.
- Compliance with applicable building codes, standards, and permits.
- Verifying supplier information, pricing, and delivery capability.
- Verifying mix designs and manufacturer specifications.
- Retaining licensed engineers and other professionals when required.
- Maintaining the confidentiality of your account credentials.
- Providing and keeping accurate account information.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any law.
- Commit fraud, send spam, or misrepresent your identity.
- Infringe intellectual property rights of MudHub or any third party.
- Attempt to gain unauthorized access, probe, scan, or interfere with security.
- Upload malware or scrape the Service at abusive rates.
- Reverse engineer, decompile, or extract the source code of the Service.
- Resell, sublicense, or redistribute the Service without written permission.
6. Intellectual Property
The Service and its original content, features, and functionality — including software, calculators, documentation, and branding — are and will remain the exclusive property of Townrents LLC and its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes in accordance with these Terms. You retain ownership of the project data, customer records, and other content you enter into the Service and grant us a limited license to host and process that content solely to provide the Service.
7. Service Availability
We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. Features may change, be added, or be removed at any time.
8. Payments, Subscriptions, and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, currency conversion, tax, and refund mechanics for purchases made through the Service are governed by Paddle's Checkout / Buyer Terms, which apply to your purchase in addition to these Terms.
Subscriptions renew automatically at the end of each billing period at the then-current rate until cancelled. You may cancel a subscription at any time; see our Refund Policy for how to request a refund.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY:
- Against cracking, spalling, curling, or other concrete defects.
- Of structural performance, load capacity, or durability of any pour.
- Of compliance with any building code or jurisdictional requirement.
- Of the accuracy or completeness of the supplier directory.
- Of the accuracy of any calculation, estimate, or recommendation.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOWNRENTS LLC AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR BUSINESS OPPORTUNITY. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (a) THE AMOUNTS YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (b) ONE HUNDRED U.S. DOLLARS. NOTHING IN THESE TERMS EXCLUDES LIABILITY FOR FRAUD, DEATH, OR PERSONAL INJURY WHERE SUCH EXCLUSION IS PROHIBITED BY LAW.
11. Assumption of Construction Risk
You acknowledge that concrete construction involves inherent risk. By using the Service, you assume all risk associated with the design, planning, ordering, placement, finishing, curing, and long-term performance of any concrete work. Townrents LLC is not a party to your construction activities.
12. Indemnification
You agree to defend, indemnify, and hold harmless Townrents LLC and its affiliates, officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from (i) your use of the Service, (ii) your violation of these Terms, (iii) your violation of any third-party right, or (iv) any claim that your project or construction activities caused damage to a third party.
13. Suspension and Termination
We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations. Upon termination your right to use the Service ends immediately. Sections that by their nature should survive termination (including disclaimers, indemnity, limitation of liability, and intellectual property) will survive.
14. Modification of Terms
We may revise these Terms from time to time. Material changes will be notified in the Service or by email and we will bump the version above. Your continued use of the Service after the effective date constitutes acceptance.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Delaware for the resolution of any dispute arising from these Terms or the Service.
